What these conditions cover
These conditions set out the basis on which Affinity Search Partners makes this website available to you. They apply to every page of the site. By opening the site, reading it or following a link from it, you accept them. If they are not acceptable to you, the answer is simple: close the page.
What this site is for
This site describes the recruiting services we offer: placing technical staff on contract, on contract-to-hire terms or permanently, and placing technology leaders, with employers. It exists to explain who we are and how we work.
No part of the site amounts to an offer capable of acceptance, and no part of it creates a contract between us. If you decide to work with us, the engagement is set out in a written agreement signed by both sides. Where anything on this site and that agreement say different things, the signed agreement controls.
Email from us
As part of our work we send email to people in professional roles connected with what we offer, such as those who hire for technical teams or who work in technology themselves. Anyone who receives such a message can end further contact by replying to it. Our data privacy page explains what we hold, where it comes from and how to have us stop. It forms part of these conditions.
Samples on this site
From time to time this site, or a document it links to, may show a board, a chart, a checklist, a timeline or a figure to illustrate how a search works. Every such item is sample material. It is not drawn from any client's search, it describes no real placement, nor is it a promise or prediction of what a search for you would produce.
Using the site properly
You may use the site for lawful purposes only, and without getting in the way of other visitors. In particular, you agree not to:
- Disrupt, overload or damage the site or the systems that serve it.
- Attempt to get into any part of the site, its hosting or any connected system that is not openly available to visitors.
- Probe, scan or test the site for weaknesses.
- Use bots, scrapers or other automated means to copy content from the site.
Who owns the content
The text, layout, graphics, logo and other material on this site are the property of Affinity Search Partners or of those who have licensed it to us. You are free to read the site and to print pages from it to keep for reference in your own business. Any other reproduction, distribution or reuse requires our written permission. Rights in any work we do for a client are governed by the written agreement for that engagement, not by this page.
Links and the font service
From this site there are links to the main Affinity website and to a professional networking service. The typeface is loaded from a third-party font service. We do not control those services, and each runs under its own terms and its own approach to privacy. A link is provided for convenience and does not mean we endorse or take responsibility for what you find at the other end.
No warranties
The site is provided "as is" and on an "as available" basis. So far as the law allows, we disclaim all warranties, whether express, implied or statutory, including any warranty of merchantability, of fitness for any particular purpose, of title and of non-infringement, and any warranty that the site is accurate, complete, uninterrupted or free of errors.
Do not treat the site as advice, whether professional, legal, financial or about employment. It is general information about our services, so do not rely on it in place of advice suited to your own situation.
Limits on our liability
So far as the law allows, Affinity Search Partners and the people who work for it bear no liability for indirect or incidental damages, for special or consequential damages, for punitive damages, or for profits, revenue, data or business opportunities that are lost, arising out of or connected with your use of this site, however caused and whatever the legal theory. Our total liability for any claim connected with this site is capped at one hundred US dollars in total.
Not every jurisdiction allows every limitation, so parts of this section may not apply to you. Where a limitation is not allowed, our liability is limited to the smallest amount the law permits.
Your responsibility for misuse
If your misuse of this website, or a breach by you of these conditions, results in a claim, loss or expense for us, you agree to defend, indemnify and hold harmless Affinity Search Partners and the people who work for it from that claim, loss or expense, including reasonable attorneys' fees.
Governing law and how disputes are settled
Tennessee state law governs these conditions and every dispute about this site, with that state's conflict of law principles left aside.
A dispute we cannot settle by talking it through goes to binding arbitration. The arbitration sits in Williamson County, Tennessee, and follows the rules the American Arbitration Association publishes. The arbitrator's decision is final and may be entered as a judgment in whichever court has jurisdiction. This arbitration requirement falls away wherever the law forbids it, and either side may still seek relief in a court where the law reserves that right.
Other provisions
Should a court find any provision of these conditions invalid or unenforceable, that provision is severed and the rest continues in full effect. Our failure to enforce a provision on one occasion does not give up the right to enforce it another time. These conditions, together with our data privacy page, make up the entire understanding between you and Affinity Search Partners regarding your use of this site. We may revise them at any time; a revision takes effect when it is posted here with a fresh date at its head.
